    • 3. What is the purpose of processing your data and our legal basis for doing so?

      When PLUSVILLAS processes your personal data, it pursues the following purposes:

      Purpose 1: provision of the services offered by PLUSVILLAS in the marketing of real estate assets

      PLUSVILLAS provides an exclusive marketing service for real estate assets, either directly or through a network of Real Estate Agents (APIs) with whom we have agreements. Through our marketing network you can find out about all the properties we have available, their description, features and price, as well as visit them or make an offer for them and enjoy other additional services that we provide to carry out the marketing activity for the properties. By requesting and showing interest in any of the properties we market, your personal data will be processed to: (i) process your registration as an interested customer and potential buyer; (ii) process your request to visit the property you are interested in; (iii) process the submission of your offer for the property you are interested in; (iv) process and respond to your questions, enquiries or complaints made through the API or via our contact telephone number. Likewise, on our web portal, www.webplusvillas.crmparaempresas.es, you can find the properties we market published, learn their description, features, price, photos, as well as other additional services to carry out the marketing activity for the properties. By using the services offered on our portal and, in accordance with the Terms of Use of the web portal, your personal data may be processed to: (v) process your registration as a web user; (vi) process your contact request to learn more details about the property you are interested in or arrange a visit; (vii) process the submission of your offer for the property you are interested in; (viii) process your recommendation of a property published on the web portal to third parties; (ix) process and respond to your questions, enquiries or complaints made through the web contact form. 

      Purpose 2: disclosure of data to the company that owns the property and to the other companies in its Group

      Based on the performance of the contractual relationship, PLUSVILLAS may disclose your data to the company that owns the real estate asset in which you have shown interest (for example, when you request more information, request a visit or make an offer for it), as well as to the other companies belonging to its Economic Group, with the aim of managing the marketing of said property carried out by PLUSVILLAS (for example, arranging a visit with the owner, forwarding your offer for the property to the owner so that they can assess it, assessing available financing options, closing the property purchase transaction, etc.).

      Purpose 3: statistical information and satisfaction surveys 

      PLUSVILLAS has a legitimate interest in knowing both the opinion of its users regarding the properties it markets and the services it offers, as well as their interests in searching for properties, their browsing habits, etc. (for example, knowing which areas are most in demand by users when searching for properties, which types of properties are most in demand, the most in-demand price range, the days and times when the most property searches are carried out, among others) with the aim of being able to offer products and services more closely tailored to the needs of its customers and users, as well as improving both current or future products and services and its provision and marketing process.

      To achieve the objective set out in the previous paragraph, PLUSVILLAS may process your data and:

      – Conduct satisfaction surveys both by telephone and by electronic means, even once you stop being a user of the web portal or stop showing interest in a property and, in these latter cases, to learn the reasons for your departure.

      – Proceed to anonymise your data so that the information about your interests, searches and browsing habits cannot be linked back to you and, after that, conduct statistical and econometric studies (for example, understanding the customer or user lifecycle and/or identifying churn propensity models).

      Purpose 4: disclosure of data to Public Bodies and Public Administrations in compliance with legal obligations

      PLUSVILLAS must comply with certain obligations established by regulations on the Prevention of Money Laundering and Terrorist Financing, which may involve requesting data about your business or professional activity from Public Bodies in order to verify the information provided, or disclosing and/or consulting data with the Banco de España Central Credit Register (Central de Información de Riesgos), in legally established cases.

      Purpose 5: sending commercial communications about similar properties and PLUSVILLAS offers and promotions

      If you give your consent, PLUSVILLAS may send you, through any channel, electronic or otherwise, segmented commercial information about properties in which you have previously shown interest (for example, a price reduction on a property you visited or saved as a favourite in your personal user account on our web portal) or about properties with similar characteristics (for example, properties located in the same area or with a similar price to those you visited or saved as a favourite in your personal user account on our web portal), as well as PLUSVILLAS offers and promotions that may interest you, either directly or because they are related to the provision, improvement and updating of our services.

      This commercial information may be generic or personalised. In the latter case, it will involve the prior processing of your data in order to be able to profile and segment you, determine tastes, preferences and needs and, based on these, identify the information that may be of greatest interest to you.

      At any time and free of charge, you may object to this purpose so as not to receive new commercial information, offers and promotions, by indicating this via postal mail to the address stated above or by email to info@plusvillas.es. Likewise, in every electronic commercial communication you will be informed again of your right to object to the sending of commercial communications.

      Purpose 6: disclosure of data to other companies in the PLUSVILLAS Group, to third-party companies providing services related to the real estate sector and to partner companies

      If you give your consent, PLUSVILLAS may disclose your data to:

      • Other companies in the PLUSVILLAS Economic Group that provide services related to sectors involved in the marketing of real estate assets, including their financing, development, title management and other value-added services.
      • Third-party companies that provide services related to sectors involved in the marketing of real estate assets, including their financing, development, title management and other value-added services
      • Other companies with which PLUSVILLAS has entered into different collaboration agreements and which may belong to sectors such as telecommunications, financial services, consumer goods, healthcare and NGOs.

      Your data will be disclosed so that these companies can send you, directly and without the intermediation of PLUSVILLAS, offers and promotions relating to their products and services, or, upon your prior request, manage with you the marketing or provision of any of their products or services.

    • 4. What types of data do we process?

      For the purposes set out in the previous section, a set of personal data is processed, which we can divide into the following sources and categories:

      a) Data provided directly by you: at the time of registration as a web user and/or in the request you make, by completing the forms enabled for this purpose.

      The customer guarantees that the data provided to PLUSVILLAS for the provision of the requested services is true to the real situation and that they will communicate any modification affecting it. Consequently, the customer will be liable to PLUSVILLAS and third parties for any damages or losses caused as a result of failure to comply with the obligations assumed in this clause.

      b) Data derived from the provision of the service itself: all data that we already know through some prior interaction with you (for example, searches and interests regarding specific properties or properties with common characteristics, visits to properties, offers made for properties, previous purchases/sales of properties marketed by PLUSVILLAS, complaints or requests for information, etc.).

    • 5. How long will we keep your personal data?

      PLUSVILLAS will keep your personal data for as long as they are necessary for the development of the provision of the requested service or for as long as they are necessary for the development and completion of the marketing of the property in which you are interested. After this period, the data will be deleted in accordance with the provisions of data protection regulations and other applicable regulations, which implies their blocking, being available only at the request of Judges and Courts, the Public Prosecutor’s Office or the competent Public Administrations during the limitation period of any actions that may arise, to be subsequently deleted.

      For the purposes of the previous paragraph, PLUSVILLAS will proceed to block those users who are inactive, i.e., those who do not access their personal account on the web portal or interact with PLUSVILLAS by requesting any of its services for a period of 5 years. Likewise, PLUSVILLAS informs you that, if in the processing of your data the regulations on the Prevention of Money Laundering and Terrorist Financing apply (for example, when you ultimately acquire a particular property marketed by PLUSVILLAS), it is obliged to keep your personal data for a minimum period of ten years.

    • 6. To which recipients do we disclose your personal data?

      PLUSVILLAS may disclose your data to all those entities and bodies with respect to which it has an obligation or has obtained your consent. Among others, the following:

      • Authorities or official bodies in other countries, located both within and outside the European Union, in the context of combating fraud, terrorist financing and serious forms of organised crime and preventing money laundering. Among others, your data may be disclosed to the Executive Service of the Commission for the Prevention of Money Laundering and Monetary Offences – SEPBLAC when required.
      • Courts and Tribunals, and State Security Forces and Corps, in the event that PLUSVILLAS may be required to disclose personal data in the context of a judicial investigation.
      • To the companies that own the property and the companies in their Economic Group.
      • To the companies and partners for which you have granted consent.
    • 7. Are there International Data Transfers?

      In certain cases, PLUSVILLAS carries out International Data Transfers in compliance with the requirements of the European Data Protection Regulation. In this regard, when the owners or managers of the assets, or their parent company, are located in the USA, your data may be transferred to that territory for the prevention of money laundering and terrorist financing, for which we will request your free, express and unequivocal consent.

    • 8. What are your rights and how can you exercise them?

      Our data protection regulations grant you a series of rights in relation to the processing of data involved in our services, which we can summarise as follows:

      • Right of access: you have the right to know what type of data we are processing and the characteristics of the processing we are carrying out.
      • Right to rectification: you may request that your data be amended because it is inaccurate or untrue.
      • Right to data portability: you can obtain a copy of the data being processed in an interoperable format.
      • Right to restriction of processing in the cases set out in the Law.
      • Right to erasure: you may request that your data be deleted when the processing is no longer necessary.
      • Right to object: you may request that the sending of commercial communications cease under the terms indicated above.
      • Right to withdraw the consent given.

      You can exercise your rights by email sent to protecciondedatos@webplusvillas.crmparaempresas.es or by postal mail to Calle de la Pau 2 03710 Calpe, Alicante (Spain), indicating the right you wish to exercise and attaching your ID card or similar identification documentation. You also have the right to lodge a complaint with the supervisory authority (in Spain, the Spanish Data Protection Agency).

    • 9. Do we access data from third parties?

      For the provision of certain services, it may be necessary for you to provide us with the personal and contact data of third parties (for example, first name, surname, email address or contact telephone number) whom you believe may be interested in one of the properties marketed by PLUSVILLAS

      PLUSVILLAS will process these data solely to communicate your suggestion about the property. In this regard, you guarantee the accuracy and updating of the personal data of those third parties and, where applicable, ensure that you have complied with all obligations that may be attributable to you in terms of data protection, having previously obtained their consent where necessary.
